Introductory provisions These Terms and Conditions for the purchase and use of the Teams service regulate the mutual rights and obligations of the parties arising in connection with or on the basis of a contract for the use of the services called Teams (hereinafter referred to as the "Contract") concluded between AGS Trade and a customer of AGS Trade (hereinafter referred to as the "Customer") who intends to conclude a Contract with Actionshop.cz via the portal www.actionshop.cz (hereinafter referred to as the "Actionshop Portal") and/or via another Internet address and/or another mobile application. II. Establishment of the Teams benefit programme The Customer has the possibility to set up the so-called Teams Benefit Program on the Actionshop Portal and to benefit from the advantages associated with this benefit. Customers can choose during registration whether they want "Full Registration" and then create a team where they can invite up to 20 teammates. Another way to join a Team is to "Invite a User to a Team", where the "Commander" sends a url link to a teammate and a new player is added to the team via the url. There is no charge for the Teams service and there is no need to extend or renew it. By arranging Teams, the Customer receives at least the following benefits: Discounts for purchases made on actionshop.cz when a certain turnover is exceeded. Discounts are named according to Bronze, Silver, Gold and Platinum badges. Each badge has an associated % discount on merchandise* Bronze - 3% Silver - 6% Gold - 10% Platinum - 15% A customer can get a badge with a discount by exceeding the total Team turnover**. Turnover is within the following ranges Bronze - 70 000 CZK including VAT Silver - 175 000 CZK including VAT Gold - 350 000 CZK including VAT Platinum - 700 000 CZK including VAT Priority to inform Customers with badges about new products Priority to give Customers the option to pre-order * In the event that it is not possible to apply the aforementioned discount to the product according to the badges, the highest possible discount is applied. ** Total turnover is calculated from one year back. A complete list of benefits provided to Customers using the Teams benefit program can always be found on the actionshop.cz Portal. III. Withdrawal from the Teams benefit program The Customer has the possibility to withdraw from the benefit program Teams without giving any reason at any time. The Customer may withdraw from the Teams benefit program in one of the following ways: Withdrawing from the Team in the user account in the "My Team" section by clicking on "dismiss team". Removing a team in the user account in the "My Team" section, click on "remove team" - you must be an administrator ("captain") Electronically by email to info@actionshop.cz In case of withdrawal from the Teams benefit program the Customer will lose the discounts associated with this service. IV. Cancellation of the Teams benefit program The Customer may cancel their Premium Membership at any time without giving any reason in one of the following ways: Delete a team in the user account in the "My Team" section, click on "delete team". electronically by email to: info@actionshop.cz Please note that by cancelling their Team, the Customer will lose all benefits and discounts associated with it. V. Liability and Warranties AGS Trade shall not be liable for any damages or any other consequences suffered by the Customer based on or related to the actions of individual Customers, the manner in which they use the AGS Trade Portal, or other circumstances arising on the Customer's part. AGS Trade shall not be liable for damages caused by force majeure, nor for any outages of the actionshop.cz Portal caused in particular by interruption of the power supply, in accordance with the provisions of § 2913 paragraph 2 of the Civil Code. AGS Trade reserves the right to temporarily limit the provision of all benefits associated with the Teams benefit program. Such limitation of the services provided may be caused by an extraordinary and unforeseeable situation which may result in temporary exhaustion of AGS Trade's capacities (in particular, a company emergency caused by the uncontrolled spread of a disease (e.g. COVID-19) or unforeseeable nationwide and/or local restrictions by the Government of the Czech Republic or other competent authorities). AGS Trade is not responsible for the smooth, uninterrupted, error-free and safe operation of the actionshop.cz Portal. AGS Trade shall not be liable for advertising or promotion carried out by any third party through the actionshop.cz Portal, nor shall it be liable for any errors resulting from third party interference with the actionshop.cz Portal or its use contrary to its intended purpose. AGS Trade is not responsible for services provided by entities other than AGS Trade, in particular the operators of the payment systems listed in Article II of these Terms of Use of the Teams Benefit Program. VI. Final Provisions If the relationship related to the use of the Portal actionshop.cz or the legal relationship established by the Agreement contains an international (foreign) element, then the parties agree that the relationship is governed by the law of the Czech Republic. This does not affect the rights of the Customer (consumer) arising from generally binding legal regulations. The resolution of any disputes shall be entirely within the jurisdiction of the court of the Czech Republic having local jurisdiction according to the registered office of AGS Trade. Customers may address complaints to the Czech Trade Inspection Authority (www.coi.cz), the state supervisory authority for consumer protection. AGS Trade is authorised to carry out this activity on the basis of a trade licence and the activity is not subject to any other authorisation. Trade control is carried out by the Trade Licensing Office within its competence. AGS Trade is entitled to terminate the sale of goods and/or provision of services on the actionshop Portal at any time. AGS Trade shall be entitled to amend or supplement these Terms and Conditions of Use of the Teams Benefit Program at any time to a reasonable extent, which shall be communicated to Customers in advance by email or other appropriate means so that they can familiarize themselves with the current version of the Terms and Conditions of Use of the Teams Benefit Program without undue difficulty. If Customers do not agree with the change to the Terms and Conditions of Use of the Teams Benefit Program, they may withdraw from the Team at any time and not be part of the program. If any provision of these Premium Terms of Service is or becomes invalid or ineffective, the provision whose meaning is as close as possible to the invalid or ineffective provision shall take the place of such invalid or ineffective provision. The invalidity or ineffectiveness of any provision shall not affect the validity and effectiveness of the remaining provisions of these Premium Terms of Service.
